The judgment was handed down on Friday in the Durban Labour Court.
"The Honourable Justice Cele ruled that the company is to comply with a fair procedure in the event of it proposing retrenchments, that the employer is interdicted and restrained from dismissing any of the employees without complying with the requirements of the Labour Relations Act, ordered the employer to re-instate any workers already retrenched," it said.
Simunye Clothing is owned by Alex Liu, the chairman of the Newcastle Chinese Chamber of Commerce, who, according to Sactwu is intent on the "willy nilly" dismissing of workers.
"We are determined to fight such unfairness," said Sactwu.
