Court allows South African investor to join G-Mobile

The commercial court in Blantyre has allowed G-Mobile to engage South African investor Berlyl Telcoms into its project. Malawi Communication Regulatory Authority (MACRA) in July 2008 gave G-Mobile a licence, as Globally Advanced Integrated Networks Limited (GAIN) and according to the agreement, the company is supposed to roll out before the end of the year or risk revocation of the licence.
However, owners of Comstar, Harris Chinguwo and Ewen Hiwa, who joined G-mobile as directors and minority shareholders, sought the court's intervention after noting that major shareholder Limbani Kalilani, approached a Botswana-based partner Peter Lamplough who had no money.
The court heard that even upon realisation that Lamplough did not have money to invest in the project, he was not cooperative to allow the South African Berlyl Telcoms, which had signed an agreement with Comstar, to buy majority shares in the company.
The judge Justice Michael Mtambo ruled that the two should go ahead with the agreement with Berlyl, and in the process allow it to buy majority shares.
