SABC, MWASA agreement terminated

The SABC has decided to terminate the agreement between itself and the Media Workers Association of South Africa (MWASA) following the signing of a collective agreement between the SABC and its organised labour at the corporation, on 11 December 2002.

The decision to terminate the agreement follows MWASA not complying with clause 6, which states that the union needs to have 20% or more of the employees employed by the SABC in the bargaining unit to enjoy organisational right. The union was given sufficient notice period, to improve its membership numbers, which it did not achieve.

The SABC therefore invoked the provisions of clause 7.4 of the agreement, which states, "If MWASA fails to rectify the threshold, then the organisational rights that were created by the said threshold will fall away until MWASA has again met the requirement."

Should the union be able to meet this requirement, it will need to reapply to be recognised as a union by the SABC.
