Horse breeder sues Phumelela and Govt over 'discriminatory' agreement

According to Independent Online, thoroughbred horse breeder and businesswoman Phindi Kema is taking JSE-listed Phumelela Gaming and Leisure and the Gauteng government to the Equality Court.

Kema says in her affidavit that an agreement signed by the two entities transferring racecourse assets to the horse racing firm is discriminatory against other players in the industry and to taxpayers. She also says the agreement has created a situation that is causing pain and suffering to her and her family.

The three horse racing clubs that ran racing in the province transferred their assets to a new company, Phumelela, which took over the management of the sport and has since taken over the horse racing in all provinces except KwaZulu-Natal and the Western Cape.

Kema is no stranger to battles with Phumelela. Independent Online reports that, in March, the Competition Commission thwarted attempts by the Thoroughbred Horseracing Trust, a 35% shareholder of Phumelela, to acquire the Kenilworth race club, in Cape Town, from Gold Circle.
