Loeries is over for another year and we're back in wintery Jozi . But where memories are patchy or fading, photographic evidence remains! There's also been more serious happenings in the last week than the advertising industry's annual blowout and congrats go to South Africa's new press ombudsman, Joe Thloloe and the newly-constituted Press Council launched last week. The council's aims include, among others, upholding the right of freedom of speech and press freedom, as guaranteed in the South African Constitution. Members of the public have been included on the council for the first time as well to ensure that in turn, the fourth estate maintains and upholds the highest standards of journalism through self-regulation by the press ombudsman and the Appeal Panel. The Appeal Panel will be headed up by Judge Ralph Zulman, due to retire from the Bloemfontein Court of Appeal. He replaces Judge Edwin King.

    Loerie Awards comments on partial results leak
    The Loerie Awards confirmed yesterday, Wednesday, 1 August 2007, that there had been a partial leak of certain award results in the run up to the festival weekend. According to a press statement, the results were not released on the Loeries website, but were captured through a Google indexing process and could be viewed via a cache of information stored on Google's website. This was a direct result of a software error.

    Online creative disappoints at Loeries 2007
    [Elan Lohmann] Being at the Loeries in Margate this weekend was amazing. It was a slick and festive affair full of joy and celebration. It was marvelous – but the state of online in advertising left me feeling rather deflated. For a start – only one online advertising contestant featured – and there was not even a sniff of a Gold or coveted Grand Prix.

    The SA National Editors' Forum (SANEF) yesterday, Thursday, 2 August 2007, objected to FIFA's application to the Department of Trade and Industry under the Merchandise Marks Act 1941 – Section 15 1(b) – for a blanket prohibition on the use of language which describes the 2010 FIFA World Cup in various ways and the emblems or logos relating to the games, calling for a blanket exemption for all the media from such a prohibition.

    The Competition Commission has referred its finding of price discrimination against MTN to the Competition Tribunal for adjudication, it announced yesterday, Monday, 30 July 2007. The referral arises from a complaint of anti-competitive conduct by MTN in relation to the interconnection fee it charges Cell C for its Community Service Telephones (CSTs).

    New regulations aimed at standardising the opt-out process for SMS messages come into effect tomorrow, Wednesday, 1 August 2007. The regulations make it compulsory for companies sending SMS messages within South Africa to offer consumers a way of opting out from receiving unsolicited commercial SMSes by replying with the word ‘STOP' from their cellphones, which will “greatly simplify the process of stopping unwanted SMS messages” according to Dr Pieter E Streicher, MD of BulkSMS.com.

    Child actors, models and the law
    While the new Children's Act introduced during June 2007 contains no direct consequence for the entertainment industry, the act is not yet completed. Specific provision is made for the Minister of Labour to broaden the scope of what could constitute prohibited child labour, according to entertainment lawyer Charl Groenewald.
