Business Report quotes Icasa's spokesman Paseka Maleka as saying that the court application was lodged on Monday and TopTV was given until the close of business yesterday to file its answering affidavits.

The case is due to be heard in the Johannesburg High Court on Friday. Business Report says that TopTV was not available to comment on the court action.

Icasa says it will hold a public hearing on a pornography channel on Monday.

Last month TopTV distanced itself from the pornography channel, saying that it had no connection with PSatTV, which intends to launch the pornography channel.

In a media statement released in December it said: "TopTV would like it placed on record that it is not currently nor has it been in the past, in any discussions with PSatTV regarding an adult content channel to be carried via the TopTV platform, nor is it in any way associated with PSat.TV. TopTV is not aware of, and neither has it approved, the channel referred to in the newspaper articles, nor has such a service been discussed with or condoned by TopTV."
