I walked into a leading couch emporium in a new design centre in Bryanston a week ago and made enquiries about the stunning L-shaped leather couch in their window that was priced at just under R10 000 on "Special Offer", presumably for their opening... too good to be true? Obviously, since none were available for sale and unlikely to be in the next six months, as there was no stock. This 'bait marketing' tactic used by this brand means I will never shop at that store again, but what do they care, right? I'm just the consumer... However, in terms of the new Consumer Protection Bill, what they did will be illegal in future and they could be fined and I could be compensated. The protection of the consumer from such unscrupulous marketing tactics is one of the good things about the new Bill and we all applaud it. However, the Bill is so poorly constructed and disadvantages suppliers to the extent that many perfectly legal marketing promotions and discounts are so tied up in red tape that it could increase prices for consumers instead. Enrico du Plessis, who is the mover and shaker behind a new marketing body, and Alison Lee, the head of the Corporate Lawyers Association, are to be applauded for their recent efforts to make sure that their submissions to the DTI regarding the new Bill benefit both the marketer and consumer. The deadline is today and now it's up to Government to ensure that the industry's comments are taken seriously.

Enjoy! Louise Marsland, editor, www.bizcommunity.com

Marketers reject new consumer bill as 'unworkable'
[Louise Marsland] The draft Consumer Protection Bill is currently unacceptable, unworkable and cannot be accepted by either the legal or the marketing community, say marketers and corporate lawyers who spent the past few days preparing submissions to the Bill in Johannesburg and Cape Town. The DTI is seen as trying to streamroll the controversial Bill through by giving the industry almost no time to comment: submissions are due Monday, 15 May 2006.

Make your submissions to the Consumer Protection Bill
EXCLUSIVE: The urgent deadline for submissions to the Government's new Consumer Protection Bill is Monday, 15 May 2006. The fledgling Marketing Association and Corporate Lawyers Association of South Africa have already made their submissions and are calling on all other interested parties to do so if they can. The deadline for submissions was moved by DTI from May 26 to May 15, 2006, without warning, according to marketers and the lawyers. On our site, exclusive for Bizcommunity.com readers, is The Marketing Association's submission. Anyone is free to download it, amend and use the content to send their own submission to the DTI.

    Investing in marketing communications
[Marcus Courage] By and large, media institutions have invested only very limited resources in reporting on Africa, often covering the entire continent (54 countries) from a single office located in Johannesburg. They venture north of the Limpopo to cover political elections, famine or conflict, but not business. Is it any wonder then that African economies simply do not appear on the radar screens of international investors?

    Poor website performance costing millions

New Pepsi ad shouldn't work - but it does
[Chris Moerdyk] The new television commercial officially welcoming Pepsi back onto the South African market should be a flop by everything that marketers hold dear. What makes a call centre a good one? - Synovate
"Measuring customer satisfaction alone cannot guarantee that your contact centre is a good one. The secret lies in firstly, measuring the right things - those that really make an impact on customers - and secondly, using the information on an ongoing basis and linking the measurement to an improvement in contact centres," says Jon Salters, MD of Synovate Sub-Saharan Africa.

    Sweetening up the local market

Easy to open, store and pour
The most significant shift experienced in the dairy industry to date has been the challenge of keeping abreast of technological advancements in the design and implementation of packaging. Douglasdale Dairy, which launched its new packaging design in 2005, recently commissioned Elopak South Africa to produce Pure-Pak Mini-Diamond cartons, a lightweight packaging solution with the added convenience of a re-sealable screw cap.

SA FMCG companies face "winner's dilemma"
South African consumer goods manufacturers have consistently delivered far better shareholder returns than their global peers, as well as most other companies listed on the JSE, elevating investor expectations in terms of future share price performance - and they are thus facing the archetypal "winner's dilemma", according Accenture senior executive Wayne Borchardt.

    GDS: fad or genuine requirement?

National Brands Limited has revitalised the packaging of its Frisco and Koffiehuis brands. The new packaging, designed by Jansen Graphics, comes in a variety of pack sizes. The Frisco packaging re-launch has been supported by initiatives including a brand new TV advert, outdoor campaign and a winter SMS promotion with a 30" television commercial, as well as innovative POS, "shopper stoppers" and other in-store elements. Koffiehuis also celebrated its new look by offering one lucky consumer the chance to create a new look for themselves or their home with a prize of R100 000.

    Sales
Don't aspire to be the cheapest
[Richard Mulvey] Price is always an emotive issue. "We have to lower the price to keep in line with the competitors." I hear the same statement from sales teams throughout the country. "How do you expect us to sell at this price?" they say, or "I couldn't make the sale, Boss, the customer was putting too much pressure on me to lower the price." Actually, price is not the most important issue as far as your customers are concerned.

Canderel is the headline sponsor of the Elle New Talent show at this year's Sanlam SA Fashion Week, to be held at Sandton Convention Centre, 27 - 30 July, 2006. This week saw the launch of SABC/Vega Ulimi Lwami (my language centre) in Cape Town and Durban, born out of a need to start creating advertising that has been conceptualised in African languages and based in a true South African cultural context - advertising that rings true with the target audience, is not simply a direct translation from English, and doesn't perpetuate stereotypes or patronise its audience.
