Malawi: Court stops MACRA from revoking G-Mobile licence

Malawi's Zomba High Court has given G-Mobile a flicker of hope as it has stopped the Malawi Communications Regulatory Authority (MACRA) from revoking the mobile service providers licence until the matter is heard before the court.

Another case waits before the Mzuzu High Court where G-Mobile is challenging a US$6 million penalty MACRA slapped the company with for its failure to roll out as scheduled.

    G-Mobile granted injunction

Zomba High Court Judge Justice Godfrey Mwase granted G-Mobile an injunction order on 5 October 2010, which will remain valid until determination on the matter is made by the court.

The order sourced by Bizcommunity reads in part: "An injunction is granted restraining the respondents by themselves or their agents and/or employees from revoking the applicants licence and treating the licence as revoked and enforcing or implementing the decision contained in the respondents letter dated 20th September, 2010."

The matter before Mzuzu High Court will resume on 13 October 2010.

    G-Mobile fails to meet deadlines

"MACRA should have waited for its outcome as the original court order was stopping them from interfering with our work," said G-Mobile administration manager Harold Muyaba.

MACRA, on 20 September 2010 announced that it had revoked the operators licence it gave to G-Mobile after its failure to beat several deadlines set for the company to roll out.
