Cell C trademark provisionally refused

Mobile operator Cell C, has responded to reports that its new logo had been rejected by the Registrar of Trademarks, saying "This is not the case. Its application to register its logo as a trademark has been provisionally refused".
Cell C responds to reports

"There has been a lot of debate about Cell C's new logo, which we welcome. However, it has been incorrectly reported that company's 'logo has been rejected'. This is not the case. Its application to register its logo as a trademark has been provisionally refused. The provisional refusal of trademark applications is not uncommon. As part of the trademark registration process, companies can make representations to the Registrar in response to the reasons for the provisional refusal.

Prior to revealing the new logo, the company took legal advice from experts in the trademark field and followed all the relevant procedures in order to apply for the registration of the trademark. It must be noted that due to an administrative error by the Registrar, the company only received the official notification of provisional refusal and the reasons from the Registrar yesterday afternoon.

There are numerous well-known brands and logos, which are in daily use in South Africa, which have not yet achieved final trademark registration status. In addition, even if an applicant does not ultimately succeed in registering a mark or logo as a trademark this does not stop the applicant from continuing to use the mark or logo."

Isn't this typical - a company thinks it can changes people hearts and minds by just changing a logo. It's always about the visual presence and never about anything of substance. I received a phone call today from a Cell C telesalesman. He told me about the offer and when I showed disinterest he hung up while I was talking. No thank for your time, goodbye, nothing. Poor Trevor-
Trevor Noah is a very likeable guy and even his TV show has great potential, however I feel sorry for him having alligned himself this closely to this campaign. The issues with the logo, the debate about whether any of this was real or just a carefully orchestrated campaign and the subsequent fallout from consumers means that the poor guy's credibility is going down super fast. C is for clumsy!-
The huge advert taken out in the Sunday Times is a really weak attempt at trying to reverse some sense into what is beginning to feel like one of the BIGGEST branding cock-up of our time.

I do not believe that the copy write sign turned through 90 degrees is honestly a person with a circle of care or innovation around him/her...

And I am still not sure that you are allowed to use the TM mark next to a symbol that has not actually been trade marked? Can someone comment on that? Is it legal?

What really gets me upset, and perhaps I should face my anger, is that the real CEO of Cell C, Lars, apparently felt that SA design companies could not possibly conceive of a logo for Cell C. I understand that some overseas company designed the thing... It is disappointing that Lars has such little faith in local design. It is even more disappointing that his experts from abroad have managed to produce such a stupid, silly pointless waste of money mark for Cell C.

I am almost certain that you are not allowed to use the TM mark next to a logo that is in fact not trademarked. Also, how on earth are you ever going to trade mark a copyright symbol? Unless you are trademarking the whole clutch of elements and symbols... the colour band, the word mark and the circled C? Who designed this logo? Not very well thought through, and in my personal opinion, not a very successful logo at all. What a waste. Posted on 23 Aug 2010 18:47

I stand correct but I think you can use the TM if the application has been submitted and then when it is accepted you use a ® to say it is a registered Trademark... or is that the other way round? Either way - good luck getting the international symbol for copyrights trademarked... if they get away with this I am gonna patent the wheel!!! Posted on 1 Sep 2010 14:31

You don't take professional advice from top trademark law specialists and then apply to trademark something that is squarely in the international public domain. So that part is a blatant lie - unless they took the advice and simply ignored it. Now they're trying to cover up this massive blunder by saying that it is common for trademarks to be provisionally refused, suggesting they really believe they will be able to register it, and that they intend to use it even if it is rejected. I like cellc as much as I like child abusers, puss eye, stepping in dog crap and watching Trevor act like a fag on TV.Well done to your ad agency nice work copying the copy rights logo.I hope you got paid well and can retire after this Trevor, you are going to have to go live in Zimbabwe after this one.I went against my better judgment and signed a contract with cellc for a blackberry on Tuesday 2nd September.First of all the blackberry BIS does not work, their call centre told me it has been on and off since it was launched, but they still double charge me to activate it and charged me data usage for trying to use it.Next, my cell number was ported over to cellc, today it is still not active, so much for trying to run a business, they activated the wrong cell number to my line. I told the sales people in the shop, phoned 140 a million times, emailed customer "care" a 100 times, phoned cellc head office in JHB and I told Trevor and I have been doing this every day since Wednesday. Lucky I didn't hold my breath, cause my phone is still not working. I finally received a call from the porting department (Saturday morning) who told me they don't work on the weekend and it can only get processed on Monday. I asked her why they didn't do it on Wednesday when I told them the problem????? I am tired now, so F#@#cking tired of cellc "CRAP" service.Please please please, pretty please, can Vodacom or MTN save me from my sins I promise I will never do it again. Posted on 4 Sep 2010 18:44
