The practical application of The Protection of Personal Information Act (POPI)

The Protection of Personal Information Act (POPI) was assented in November 2013, but the gist of the Act has not commenced yet. Non-compliance may lead to a fine of up to R10m, imprisonment of up to 10 years or a civil action. Notwithstanding any penalties within the Act, the affected party will suffer reputational damage, possibly lose potential clients and ultimately lose money.

Data and personal information are processed by both private individuals and companies on a daily basis. The manner in which this information is processed and protected is of vital importance. In a digital age where most information is processed electronically, the risk of information falling into the wrong hands is much higher.

• What falls under personal information
• The application, interpretation and effect of POPI Act
• Explanation of terms and concepts in POPI Act
• Practical implementation within an organisation
