Competition law – the South African experience

Law@work, UCT Faculty of Law, is pleased to present a two-day course in competition law, from l - 2 September 2016.

Join the Minister of Economic Development, the Judge President of the Competition Appeal Court, members of the Competition Tribunal and Competition Commission, as well as leading practitioners and economists for a two-day intensive masterclass and debate of cutting-edge competition law and economics.

ABOUT THE COURSE
South Africa abides by the best international practice of a free market principle. However, competition is heavily controlled by the Competition Act of 1998. Compliance with competition law has far-reaching implications for local and foreign businesses. Competition law forms a critical part of the business landscape and plays a vital role in influencing firms' corporate and commercial strategies.

This two-day course will provide an in-depth look at competition law in South Africa. Our panel of academics, legal practitioners, competition economists and regulators will give insights into the policy and legal framework of competition law in South Africa and will balance lectures on the technical legal and economic analyses of competition law with practical examples from case studies and recent legislative and policy developments.

WHO WILL BENEFIT FROM THIS COURSE?
Legal practitioners, advocates and attorneys advising businesses operating in South Africa or that have dealings in South Africa, internal legal counsel, compliance managers and business people.

After attending this two-day course, attendees should have a good working knowledge of:
- The Competition Act, including the purpose, objectives and aims of competition policy
- The jurisdiction of the Competition Act
- The roles, powers, processes, practices and procedures of the Competition Authorities - the implementing and governing bodies for Competition Law are the Competition Commission, the Competition Tribunal and the Competition Appeal Court
- The economic principles underpinning competition policy and law

• Round table with Minister regarding
- merger control and public interest
- criminalisation and leniency
- market inquiries
- abuse of dominance
• Economics of excessive and predatory pricing
• Criminalisation and its impact on advising clients
• Assessing the impact of merger conditions
• The economics of mergers and the presentation of expert evidence
• The conduct and implication of market inquiries

Programme and venue information:
Signing in will commence at 9:00 on the first day unless otherwise advised. Each day will end at approximately 17:00.

Award of certificate:
A certificate of attendance from UCT will be issued to those who attend both days. Please ensure that you sign the attendance register every day.

Closing date for registration:One week prior to the course.

Course fee:
R10,995 per delegate. Includes parking, teas, lunches, a gala dinner on Thursday evening, and any course materials. NGO's and public entities may apply for reduced fees.
