This course provides an overview of the fast-growing and dynamic field of environmental law in South Africa. Selected themes will be covered and these are designed to provide students with an opportunity to gain insight into the dynamics of environmental law.
Learning Outcomes:
After completion of this course participants should be able to:
- Have a clear understanding of the nature and scope of environmental law
- Provide a historical perspective of environmental law
- Discuss the sources of environmental law and basic environmental law norms
- Discuss the constitutional protection of environmental rights in South Africa
- Discuss the methodology to interpret environmental provisions
- Comment on environmental governance in South Africa
- Identify the various levels for the effective administration and implementation of
environmental laws
- Distinguish the various legal remedies available in law to ensure proper protection of
environmental rights
- Know the salient provisions of the framework legislation that govern South African
environmental law
- Provide a detailed discussion of the general duty of care under s 28 and the procedure to be
followed upon a failure to take the required measures
- Discuss the environmental dimension of physical planning in South Africa
- Understand the new EIA procedure in South African law
- Identify the listed activities for which an EIA is a prerequisite
- Understand the legal nature of water rights in South African law and the obligations vis-à-vis
water use
- Discuss the general legal principles that govern pollution in South African law
- Reflect on the new Air Quality Act's system of air quality management
- Discuss land-based pollution regulation
- Describe the environmental obligations during the various phases of mining: viz. prospecting,
mining authorisation, rehabilitation and closure
- Explain the regulatory framework governing biodiversity
- Understand the law pertaining to marine pollution
- Understanding the powers of environmental management inspectors (EMIs) in compliance and enforcement
