The Constitutional Court has provided important clarity on the procedural pathway available to employees dismissed for operational requirements following a facilitation process. The judgment resolves a long-standing interpretative dispute regarding whether conciliation is required before approaching the Labour Court in large-scale retrenchment cases.

Why SA’s labour laws are failing young workers

Forty-five-point eight percent. That is the unemployment rate among South Africans between the ages of 15 and 34. Nearly half of an entire generation is sitting outside the formal economy, not because they lack ambition, not because opportunity does not exist somewhere in this country, but because the bridge between a willing young person and a willing employer has, over time, become too costly for either of them to cross.

New earnings threshold now in effect: Are your employment contracts compliant?

A new earnings threshold took effect on 1 May, raising the level at which employees qualify for certain protections under the Basic Conditions of Employment Act (BCEA). On the surface, the adjustment of 3% – to R269,601 per year, or R22,467 per month – appears modest. In practice, it alters how a significantly greater portion of the workforce must be managed.

Failure to manage disciplinary hearings in line with current legislation can have costly consequences for employers, potentially resulting in the forced reinstatement of or compensation for dismissed staff — even those accused of criminal conduct.
