The aim of this workshop is to explain what the law requires in order for you hold a disciplinary hearing which is both substantively and procedurally fair.
Before an employer may dismiss an employee for misconduct, the law requires that the employer must first hold a disciplinary hearing. Every disciplinary hearing must be both substantively and procedurally fair. If it is not, the employee may succeed with a claim for compensation against the employer in the relevant forum. The employee may even succeed with a claim to be reinstated.
The workshop focuses on explaining the step-for-step procedure of a disciplinary hearing and the roles and responsibilities of each person at the disciplinary hearing.
It concludes with a role play which implements all the principles which have been explained practically. In short, this workshop will enable you to confidently manage any disciplinary hearing.
