    Home Affairs studying High Court ruling

    PRETORIA: The Department of Home Affairs says it is studying the judgement of the Western Cape High Court, regarding the implementation of the new immigration regulations.

    "The department is still studying the judgement and will provide comment in due course," it said on Monday, 30 June.

    The department was taken to court by Brent Johnson, whose Danish wife was denied entry into South Africa after the department declared her as an "undesirable person", after a short visit outside the country.

    She wasn't allowed back into the country, as the new visa regulations stated that a foreigner married to a South African must return to their home country and apply for a spousal visa at the South African mission.

    The couple had been living in South Africa for five years.

    The court, however, ruled that the status be suspended and that they should be allowed to return to South Africa.
